Europlasma takes Nanowatt to court for copyright infringement

Belgium-based Europlasma has filed a copyright infringement lawsuit against Nanowatt in Ghent, Belgium.

The suit alleges that Nanowatt has copied, reproduced, and distributed Europlasma’s copyrighted technical drawings and trade secrets without permission to reproduce plasma coating machines.

Apart from the company, the lawsuit includes two former Europlasma employees who now work at Nanowatt, namely Taco 12 BV, the company’s director; and Mark Sercu.

The plasma coating is done for medical devices to increase the wettability of these devices, including balloon catheters and intra-ocular lenses. The plasma coating machines can also plasma fine cleaning, activation or etching.

Europlasma is seeking compensation for financial damages along with a permanent injection of Nanowatts regarding the use and distribution of Europlasma’s copyrighted materials, including trade secrets and technical drawings.

The Belgium-based company is also asking for a recall and destruction of any machines built using the copyrighted material under the penalty of a fine, in addition to the cancellation of any current or future orders.

Recent instances of alleged intellectual property theft lawsuits include Curevac’s ongoing patent litigation with Pfizer / BioNTech regarding the intellectual property rights governing messenger ribonucleic acid (mRNA) technology that was used to develop CureVac’s Covid-19 vaccine. The lawsuit alleges that patent-protected elements were used to produce and market Pfizer/BioNTech’s Covid-19 vaccine Comirnaty.

In September, 10X Genomics won a preliminary injunction against NanoString Technologies to stop the selling or providing services using the former’s CosMx Spatial Molecular Imager (SMI) instruments and CosMx reagents for RNA detection in all 17 countries of the European Unified Patent Court.
